But Keith Whittington argues that the Court's justices have not simply seized power and circumvented politics. The justices have had power thrust upon them--by politicians, for the benefit of politicians. In this sweeping political history of judicial supremacy in America, Whittington shows that presidents and political leaders of all stripes have worked to put the Court on a pedestal and have encouraged its justices to accept the role of ultimate interpreters of the Constitution.
Whittington examines why presidents have often found judicial supremacy to be in their best interest, why they have rarely assumed responsibility for interpreting the Constitution, and why constitutional leadership has often been passed to the courts. The unprecedented assertiveness of the Rehnquist Court in striking down acts of Congress is only the most recent example of a development that began with the founding generation itself. Presidential bids for constitutional leadership have been rare, but reflect the temporary political advantage in doing so. Far more often, presidents have cooperated in increasing the Court's power and encouraging its activism. Challenging the conventional wisdom that judges have usurped democracy, Whittington shows that judicial supremacy is the product of democratic politics.

From the author: The Supreme Court regularly upholds federal legislation on grounds other than those stated by Congress. Likewise, an appellate court may affirm a lower court judgment even if the lower court's opinion expressed the wrong reasons for it. Not so in the case of judicial review of administrative agencies. The established rule, formulated in SEC v. Chenery, Corp., is that a reviewing court may uphold an agency's action only on the grounds upon which the agency relied when it acted. This Article argues that something more than distrust of agency lawyers is at work in Chenery. By making the validity of agency action depend on the validity of the agency's justification, Chenery's settled rule enforces an aspect of the nondelegation doctrine that has been obscured by more recent decisions that understand nondelegation as involving only a demand for legislative standards, or "intelligible principles." The neglected arm of the nondelegation doctrine, which Chenery, enforces, holds that a delegation is constitutionally valid only if it requires the agency exercising the delegated authority to state the grounds for its invocation of power under the statute. Chenery's enforcement of this norm polices the political accountability of agency action by ensuring that accountable decision-makers, not merely agency lawyers, have embraced the grounds for the agency's actions, and it promotes the regularity and rationality of agency decision-making by enforcing a practice of reason-giving. This nondelegation account of Chenery explains why agencies must engage in reasoned decision-making to obtain deference under Chevron U.S.A. Inc. v. Natural Resources Defense Council, Inc. Chenery, insists that, to receive Chevron deference, accountable agency actors must explain the bases for their decisions that bind with the force of law. By grounding Chenery, in the enforcement of the nondelegation doctrine, this account also suggests that the President's own exercise of statutory power is not immune from Chenery's demands.

From the author: There is much truth in this conventional vision of nineteenth-century governance, but far from the whole truth. This Article begins a project of recovering the lost one hundred years of federal administrative law. For statutory sources, agency practice, and common law actions in the Federalist period reveal a quite different and more nuanced picture. From the very beginning some administrators were clothed with broad statutory authority, made general rules, adjudicated cases, were located outside of departments, and were tightly bound to congressional oversight and direction. And common law actions provided a judicial review that was often more intrusive and robust than we observe in contemporary practice. If there was an original understanding of the structure, function, and control of administration in early federal law, Federalist practices suggest that it was a much more complex and pragmatic understanding than our conventional account admits.

Lattice-gas cellular automata (LGCA) and lattice Boltzmann models (LBM) are relatively new and promising methods for the numerical solution of nonlinear partial differential equations. The book provides an introduction for graduate students and researchers. Working knowledge of calculus is required and experience in PDEs and fluid dynamics is recommended. Some peculiarities of cellular automata are outlined in Chapter 2. The properties of various LGCA and special coding techniques are discussed in Chapter 3. Concepts from statistical mechanics (Chapter 4) provide the necessary theoretical background for LGCA and LBM. The properties of lattice Boltzmann models and a method for their construction are presented in Chapter 5.

This is an outstanding book for anyone concerned with computational models of real physical processes (digital mechanics or digital physics). It is accessible to anyone with a bachelor's degree in computer science, mathematics, engineering, or physics. It is also accessible to others with a few years of math courses. Lattice gasses and lattice boltzmann machines are the natural extensions of cellular automata such as the game of life.

Magnificent work by grand master!.......1999-08-20
I must say I'm a beginner in statistical mechanics but I believe Boltzmann is really worth reading because he was one of the creators of statistical mechanics. One can learn a lot by reading the works of masters. His book is of course old fashioned 19th century book and his notations are not the kind of thing you can love, but I found his book readable and enjoyable. Boltzmann works out every theorem rigorously and explains every single points in detail. It might exhaust you but at the end you can see the picture. I definitely recommend Boltzmann to everyone. P.S I also recommend Ehrenfest's book as companion of Boltzmann.

"Maria" is an unfinished novel which Wollstonecraft intended to display the cruelty, injustice, and utter lack of personal freedom of women in the late 18th century. Drawing on sources from Rousseau, to her husband William Godwin's "Political Justice" and "Caleb Williams," to her own "Vindication of the Rights of Woman," Wollstonecraft sets up a scenario in which a woman falls prey to the maddening strictures of law. Although it may not initially appear so, "Maria" is very much in the strain of gothic literature. Wollstonecraft takes pains to illustrate that the gothic need not be enacted in castles or by demons, but can be just as horrifying, if not more so, when 'normal' society proves to be an intractable villain itself.
The novel reads like a philosophical treatise, the main action being life stories told by the primary characters, Maria, her mad-house warden Jemima, and her unlikely lover, Henry Darnford, including their digressive running commentaries. As the novel begins, Maria is in the mad-house, deprived of her infant daughter by her greedy husband, George Venables, whom she despises.
As in Godwin's "Caleb Williams," Wollstonecraft does not scruple to pile severe mental anguish upon clear injustices to drive home her points regarding society's treatment of women. Her most vicious attacks are reserved for the law and surprisingly, for women. The law preserves a basis for treating women as perpetual minors, and unfortunately, women, realizing their powerlessness, too often resign themselves to their lot.
Though fragmentary and incomplete, "Maria" has the same kind of power as "Caleb Williams," and the two should be read together for maximum effect. The force of Wollstonecraft's writing comes from the fact that her observations were just, and that she dared to voice them on behalf of all women.

This book represents for the first time The Wrongs of Woman; or Maria and Memoirs of the Author of "A Vindication of the Rights of Woman" have been published in the same volume, but their history and reception have been inextricably linked since the publication of both in January 1798, less than five months after Mary Wollstonecraft's tragic early death. Designed as the fictional embodiment of Wollstonecraft's notions against patriarchy and for the rational and emotional independence of women, The Wrongs of Women tells the story of Maria, who makes a disastrous marriage and then must undergo confinement in a madhouse for her rebellion against it. Godwin's Memoirs of the Author of "A Vindication of the Rights of Woman" honored Wollstonecraft's memory with a frank and detailed account of her life and death, but instead of the profound admiration he hoped to invoke, most contemporary readers felt shock at Wollstonecraft's sexual freedom and an odd mix of pity and wonder at Godwin's willingness to share such details of his wife's life with the world. The College Publishing edition includes an erudite and accessible introduction detailing the changing critical fortunes of both works, and in order to gain an appreciation for the rich cultural contexts of these texts, a selection of contemporary reviews appears in the appendix. In addition, Wollstonecraft and Godwin's other works and, uniquely, Gilbert Imlay's novel The Emigrants, are judiciously excerpted. Short essays throughout the text provide critical background material on such subjects as maternal breastfeeding, Gilbert Imlay, employment opportunities for lower-and middle-class women, marriage laws, and childbirth in the eighteenth century.

This is a classroom edition of two works important to people interested in early debates on women's rights, the history of intellectual ideas, and late 18th/early 19th century British fiction. Both _Wrongs of Woman_ and _Memoirs of the Author_ slightly predate most of Jane Austen's publication dates and are at the beginning of British Romantic literature. The books may be an acquired taste, more often read as class assignments than for fun, but really both are interesting for the common reader too. This edition is particularly good, highlighting a number of important issues-- including debates about breastfeeding in this period, the dangers of maternity and childbirth, and the limitations that women of the period faced. Austen doesn't tell you all of this in her novels, but Wollstonecraft's novel does, and Godwin's _Memoir_ of her tells in horrifying detail how she died from an infection probably due to using a male midwife (early obstetrician). Really, the editor's notes and details are the best that I've seen for readers who are not scholarly specialists--they are clear, helpful, and pertinent. ...And this isn't because I happen to know the editor and have an edition w/ the same series.

The out-laws of the world.......2005-11-04
This unfinished story is the product of a fierce feminist and a profound socially-minded author.
It is a biting aggressive work: 'Was not the world a vast prison and women born slaves?'. 'Women, the out-laws of the world'. 'Born a woman - and born to suffer ... I feel more acutely the various ills my sex are fated to bear. I feel that the evils they are subject to endure, degrade them so far below their oppressors, as almost to justify their tyranny.'
One of the author's targets is marriage, 'matrimonial despotism of heart and conduct'.
'But a wife being as much a man's property as his horse, or his ass, she has nothing she can call her own.'
Marriage laws are absurd 'leading to the most insufferable bondage and to a false morality ... which makes that all the virtue of woman consist in chastity, submission, and the forgiveness of injuries'.
Another scandal for the author is 'the enslaved state of the labouring majority ... condemned to labour, like a machine, only to earn bread, and scarcely that'; and 'the evils which arise in society from the despotism of rank and riches.'
This hard hitting story is an outcry for greater freedom (also sexual) for women and for social justice.
It didn't loose its important message and is still very actual in a major part of the world.
