    The new Studies in Contract Law, Sixth Edition, has been revised and updated in many ways, both to cover new developments in contract law and to increase the book's usefulness as a teaching tool.

    There is a new Chapter Three, "An Introduction to Remedies." This Chapter, which follows Chapter Two on the Bases of Promissory Liability, provides an early overview of contract remedies through text, cases, and problems. It can be a "stand alone" chapter for courses when there is not enough time for a more comprehensive study or used as an introduction to the more comprehensive treatment of remedies in Chapter 7.

    There is a new Chapter Eight on Contract Dispute Resolution: Some Alternatives to Courts. This Chapter introduces the student to dispute settlement by agreement, including through mediation, and dispute settlement by private adjudication (outside of the courts), including arbitration.

    There is a new subsection in Chapter Four, The Bargain Relationship, which deals with Assent in Electronic Contracting. Building on an analysis of the so-called "Gateway" problem, this subsection reviews current legislation on electronic contracting and features a recent decision by the Second Circuit (the Specht case) on "click wrap" licenses.

    Section 2 of Chapter Five, Avoidance of the Contracts, reviews the recent decisions in California holding that one-sided arbitration clauses in consumer or employment contract are unconscionable.

    Section 3 of Chapter Five on Illegality features updated materials on cohabitation agreements, surrogacy contracts, and promissory fraud related issues.

    Section 1 of Chapter Nine, Third Party Interests, has a recent case on the assignability of rights created by structured settlements that, in turn, implement judgments in tort cases. This affords an opportunity to review the provisions of Revised Article 9 of the UCC and the common treatment of agreements prohibiting assignment.

    The provisions of Revised Article 2, Sales, which is scheduled for final approval at the 2003 Annual Meeting of the American Law Institute are incorporated into the text and problems.

    Relevant provisions of the U.N. treaty on Contracts for the International Sale of Goods and the UNIDROIT Principles of International Contracts are identified and discussed where relevant.

    Short review while I study contracts out of this book. The book is poorly written, where oftentimes the question of law is presented before the facts. Facts, though not what you should take with you, focus you to the event. Law with no facts is meaningless, and we might as well read out of the Restatement book. Sometimes the cases are pointlessly long, sometimes elusively short. Always confusing, never well written. Why put in 1st restatement when we are on the 3rd? Why tell the story out of order? Why give the procedural history before the facts? My questions go unanswered. However, as Contracts go, some of the cases they choose are interesting. Imagine if every single case was about breach of renter's agreement, or arbitration clause. At least there are some fun wheeling and dealings in here.

    It is a very rare thing when when words coil around your soul and leave you breathless and clear-eyed. Few books have the power or brilliance to be transforming, and even fewer are brave enough to launch entirely new ways of thinking about literature.

    And then comes "Studies in Contract Law: Sixth Edition," the newest book from renowned legal philosopher Murphy Et Al. A quick glance at its faux-leather cover and embossed title and you might cast it aside as yet another heavy, meandering read. But, as is often true, the adventurous will be rewarded with delights heretofore unknown to modern readers.

    "Studies" covers a startling range of topics, from the high-powered world of business to the disintegration of families throughout various eras of American history. It even briefly delves into poetry, quoting what it describes as "one of the delights of legal literature," namely the immortal Professor Brainerd Currie's "Aberlone, Rose Of." In the discussion of a presumed barren cow on page 490, the recitation of lines like "Ah me!--Ah moo! / Respectively their quidsome balm / How mournfully they chew!" grips us with longing and wistfulness.

    The frenetic pace of the text is filled with endless cliffhangers; nervous readers should take warning. Will Roscoe ever find his true father? Will the theft of Mrs. Hooper's gardenias ever be solved? Will Alaska Northern Development, Inc prevail over Alyeska Pipeline Service Co. regarding the applicability of the parol evidence rule of the Uniform Commercial Code, section 2-202, codified as AS 45.02-202? Subplots and intrigue twist throughout the book until page 1121, where a single sentence rings as sharp and true as any in history.

    "It was the best of times, it was the worst of times." "Call me Ishmael." "To be or not be." And now, from the sublime mind of Murphy Et Al: "The idea which ruled this case--that where a person for a consideration paid to him by another agrees to pay a sum of money to a third person, a stranger to the transaction, the latter does not thereby become possessed of the absolute right to the benefit of the promise, nor until he accepts the same in some way; and that while he is ignorant of the promise, or thereafter, at any time before he assents to the transaction, it may be rescinded,--we must admit is well supported in the books."

    If the poetry of this sentence does not immediately seize you, consider yourself a hopeless wreck on the shores of The New Literature.

                    I'm a film and television producer, and this is the first book I've come across that explains in plain English what it's like to work in production. But, it's tells you much more than that. By the time you finish reading this book, you'll have a complete understanding of how movies get made and the people who make it happen. You'll learn the "lingo" of the industry and the chain of command on a set. The author takes you step by step - explaining what the jobs are and how you can get one. Even if you don't want to work in production, you'll find it entertaining and informative. I have been using this book as a teaching tool in my production assistant workshops for the past few years. It has helped many of my students find work in the industry. If you want to work in this business, this is a must-read. What I liked most about the book is that it isn't the glamourized version of what it''s like to work behind the scenes, it's the real deal. In terms that anyone can understand. April Fitzsimmons has been there, done that and now written the book about it. Some of the fascinating parts include short personal stories from various people, about their experiences in the industry - the good, the bad and the ugly.

                    I recommend to my students that they buy this book and keep it with them at all times, as a reference and as a reminder to never give up. I only wish this book was around when I first started working in production. My struggle wouldn't have been so difficult.

                    This book is a Godsend. I have put the amazingly lucid and learned advice to work in my own jobs on film sets, and now my brother is finding it equally enlightening as he tests the waters of filmmaking. I will continue to recommend this book to anyone who wants to work in film or simply understand what happens on the set. Insightful without the braggadacio that festers in so many books of its genre, this is a great find for the newcomer and the production veteran alike.

                    This book should be called "How Not to Get Fired From Your First PA Job." There is a good amount of detail about what a production assistant position is, but April Fitzsimmons' book does not even begin to cover what you need to do to GET the job in the first place (and I suspect that's what most people are really looking for).

                    If you don't have connections and want a book that will actually help you get a foot in the door, this is definitely not the one. Maybe check out Kenna McHugh's "Breaking into Film: Making Your Career Search a Blockbuster." That book covers networking, different PA organizations, effective resume writing, and so on. Breaking and Entering provides none of this.

                    5 out of 5 stars For the doom of job hunting.......2006-08-25

                    I have just graduated college. Like many of my class I was thrilled at the graduation ceremony and celebrated the end of 16 year confinement callled "education." This joy was quickly replaced by my daily exercise of hair pulling about 2 weeks into my job hunting. I thought with a diploma from one of the top 5% college in the nation and skills such as trilingual should have no problem getting a job or catch the eye of the recruiter. Well I was wrong no recruiter probbaly even saw my resume.

                    About a month into the job hunting I really started to worry. I did what I always do when I run into a dead end. Went to the book store and started to do a little research to find out what I was doing wrong. Out of the entire section dedicated for "careers" this was the book that caught my eye. Instead of giving myself more headache going through thousands of resume samples or cover letter samples I wanted to know what exactly did the HR department do. I felt like at this point that they were just too lazy to look at any resume and just sit around did nothing. I was half right.

                    So instead of picking resumes that i could sample from a huge book that reminded me of the days of SAT, this book was able to give me ideas and explained some of the frustrating "WHY!!!!". About two weeks after I read it I manage to land a interview with the company of my choice and the position of my choice.

                    The book answers alot of the "myth" about the function of HR departments that I can finally lay it down.

                    This was a great book with a lot of really helpful information. The author pointed out many things that I had never really thought about before in regards to my resume and interviewing skills. He also added a bit of humor into his writing. A great find at a reasonable price.

                    As an employer, I found Mr. Karsh's book full of valuable advice for job candidates. Kids coming out of college are usually ill-prepared for the interview process, and this book contains lots of helpful hints on how to get your foot in the door, and how to get that job. This should be required reading for all college seniors!

                    I've always hated reading those over stuffy research books written by doctors who throw out big words just to sound impressive. I love "Confessions" because I feel like Brad Karsh wrote it for me. He knows he's advising college students, so he uses a conversational and real tone. AND his book isn't a compilation of research, interviews, and hearsay. All of the outstanding advice on resumes, interviews, and cover letters comes from Brad's personal experience as a Recruiting Director. A Recruiting Director is going to be the actual person who decides if I get the job - not my friends, parents, or professors. I needed the "inside guide" to get my first job, and "Confessions of a Recruiting Director" delivered. I highly recommend this book!

                    The resume section of this book is amazing! It's direct and easy to understand, and it gave me the specific steps to dramatically improve my resume.

                    As a perfectionist and inquisitive college student, I was constantly bugging my professors and career center with questions on my job search. What should I include in my cover letter? Will my posted, online resume get noticed? Do I have to send all of the interviewers a thank-you note? How long should I wait before following up after an interview?

                    This book answers all of those questions and more - and my busy professors are very thankful!

                        This book has helpful tips, advice and information for anyone looking for their first job in physics. Underclassmen, undergraduates and graduate students may find this book useful.

                        The font and colors are fairly bland, but functional. Questions for self-assessment are included along with employment data, tips for resume building, tips for networking and information about the interview process.

                        I've used this book to make a checklist of things to do during my job search. I also enjoy the data included in the book, namely the breakdown of where physics bachelors usually find employment and typical starting salaries for physics bachelors. I recommend this book to anyone looking for their first job in physics; I've found it helpful.

                                  Writing centers cannot resolve the national confusion about literacy, but over time they can contribute to a better understanding and more democratic approaches to literacy education. But to do this, writing centers need to be more fully engaged with the paradox of literacy - the way that literacy both dominates and liberates, both demands submission and offers the promise of agency. Nancy Grimm believes that postmodern theory, which emphasizes the diversity of our society, offers the best opportunities for this engagement. Her book offers a fundamental reconsideration of writing center work - work, she maintains, that must be informed by an understanding of the cultural role of literacy education.

                                  Because so many educational practices are based on tacit assumptions about the "normal" way to do things, Grimm argues that both the teaching and tutoring of literacy must be informed by a radical reconsideration of academic fairness. Change will depend on the willingness of comfortably situated people to open themselves to authentic listening and the possibilities of having their world views transformed by writing center students. "Good intentions alone, particularly good intentions grounded in a missionary narrative, are not enough to overcome the potentially oppressive nature of literacy education."

                                  Grimm begins by positioning the debate about the function of the writing center in the larger cultural conflict created by postmodern conditions. She locates writing center work within the historical contradictions of literacy, then analyzes the way composition teaching regulates an academic identity. She goes on to show how postmodern theories of subjectivity offer ways to intervene in that regulation. After reconceptualizing the politics of writing center administration, Grimm ultimately argues for a conception of fairness that holds writing center workers responsible for not only granting students membership to the academic literacy club but also for changing the gates of that club when change is necessary.

                                  Good Intentions is essential reading for educators involved with writing centers in any capacity - whether they be directors, researchers, professional and undergraduate staff, or simply teachers of students who use writing centers.

                                  This is one of those ground-breaking books that are also exasperating, because you know the author is right at least half of the time, but you don't know which half is right. Grimm's overall objective is to find a way to make higher education "fairer" for students who lack the advantages of most mainstream students who grow up in white, middle-class households, and she has written a thoughtful analysis based on wide reading across several disciplines (there are well over 100 items in the Works Cited). From the perspective of the Writing Center, which originated at the same time that growing numbers of nontraditional students began flooding American colleges and universities, she has a first-hand perspective of the mismatch between these students and the expectations of their professors.

                                  Although political, the book is not a polemic so much as an academic inquiry into time-honored values of liberal education. And she uses postmodern thought as a basis for asking questions that get at long-held assumptions about what students should learn and how they should learn it. She articulates well how discourse (the conversation that takes place among people creating knowledge) locks its participants into certain viewpoints that make it hard for them to see the perspectives ot those outside the discourse itself. But the drawback of postmodernism is that it is yet another form of discourse, with its own assumptions, and that's where a reader of the book can begin to experience it as a kind of hall of mirrors, where everything is called into question, including the author's own argument. The subject of literacy, which may seem to be a simple concept, becomes far more complex than you may have ever imagined.

                                  Fewer than 150 pages in length, the book has more packed into it than many others on similar subjects. It handles complex ideas clearly and is quite readable, with a minimum of postmodern jargon. It comes to life especially when Grimm uses the examples of actual students and tutors in her Writing Lab at Michigan Technical University in the Upper Pennisula. I strongly recommend her book to anyone looking for fresh perspectives on education and new ways of understanding literacy.

                                  If you are involved with student writers, you must read this book! Multicultural classrooms, reluctant student writers, uncertainty of how to tutor students with their writing . . . whatever the writing-related problem you bring to the reading, Grimm will give you insight and a desire to deal with it! An great read . . . many applicable anecdotes and a fabulous afterword. If you are thinking there must be something more for teaching writing, training tutors, or supporting student writers, this is it!
