Well Balanced Book on Timely Subject.......2003-04-11
Many clients and other non-lawyers believe that lawyers milk the legal system for every conceivable financial advantage. As an attorney in New York City for the past 7 1/2 years, I believe most attorneys are ethical, but a small percentage give the entire profession a bad name. Toothman and Ross' book details efforts by judges to punish the lazy, incompetent or unethical lawyer by disallowing fees while allowing diligent, competent and ethical lawyers to collect when a client seeks to avoid payment.
The opening chapters of the book focus on the unique nature of the attorney/client relationship and how this relationship impacts the allowable fee. As trusted advisor to the client, the attorney has an obligation to charge only a "reasonable" fee. The lawyer is not free to strike any deal with a client. This is becuase the client relies on an attorney not just to protect his rights in a litigation or transaction, but to properly define the scope of what needs to be done. The book goes through some examples where courts reviewed engagement letters and bills to judge whether the resulting fee was "reasonable."
The book also details a group of questionable billing practices. There are many creative ways in which some lawyers add dollar amounts to their bills. Among the billing practices discussed were charging clients for firm overhead, charging senior lawyer time for simple or clerical tasks, and charging a client for recycled work (i.e. work done for another client in a similar matter). Thankfully, most courts are not hesitant to clamp down on such abuses. The later portion of the book gives clients tips on how to manage fees and detect abuses, and lawyers advice on how to manage their cases to maximize productivity and avoid unethical billing practices.
My only modest criticism is that the authors spent less than two pages discussing class action fees.... Nevertheless, I highly recommend this book to lawyers and clients alike.

From the supplier: Litigation costs for directors' and officers' (D&O) liability insurance lawsuits reached an all-time high in 1994, according to a recent Wyatt Co report. However, the report's author, Wyatt consultant Phil Norton, contends that legislative moves currently underway may limit the growth rate of court costs and reduce the frequency of lawsuits by making losers pay all court costs, imposing a new definition of recklessness and placing a limit or cap on settlements. The report reveals that the average settlement cost of a D&O lawsuit in 1994 was $4.6 million, an increase of $1.3 million over 1993.

Systems approaches for agricultural development are needed to determine rational strategies for the role of agriculture in national development. Mathematical models and computer simulation provide objective tools for applying science to determine and evaluate options for resource management at field, farm and regional scales. However, these tools would not be fully utilizable without incorporating social and economic dimensions into their application.
The second international symposium,
Systems Approaches for
Agricultural Development (SAAD), held in Los Baños, 6-8 December 1995, fostered this link between the biophysical sciences and the social sciences in the selection of keynote papers and oral presentations, a selection of which are included in these books. The contents further reflect how systems approaches have definitely moved beyond the research mode into the application mode. The large number and high quality of interdisciplinary research projects reported from different parts of the globe, to determine land use options that will meet multiple goals and yet sustain natural resource bases, is a key indicator of this `coming of age'. At the farm level, where trade-off decisions between processes and products (commodities) feature strongly, much progress is also evident in the development of systems-based tools for decision making. At the field level optimization of resource use and minimizing environmental effects has become of major concern for which systems approaches are indispensable.
The books, of which Volume I deals with regional and farm studies level and Volume II with field level studies, will be of particular interest to all agricultural scientists and planners, as well as students interested in multidisciplinary and holistic approaches to agricultural development.

This book is the proceedings of the 7th International Summer School on Biophysics: Supramolecular Structure and Function, held September 14-26, 2000, in Rovinj, Croatia.
An enormous amount of new knowledge on the molecular basis of biological phenomena has emerged in the rapidly expanding field of biophysics. The principles and methods of modern biophysics now provide a strong foundation for all of the biosciences, and serve as a rational common language for scientists from various disciplines.
The series of books on Supramolecular Structure and Function was inspired by the International Summer School on Biophysics, established under the sponsorship of IUPAB, UNESCO, and ICGEB, held in Rovinj, in 2001, and follows the successful interdisciplinary approach.
This volume covers some powerful methods, such as analytical centrifugation, mass spectrometry, fluorescence spectroscopy, infrared spectroscopy, electron spin resonance and nuclear magnetic resonance, for the study of complex biological structures, and discusses useful physical concepts as applied to biological and biochemical systems. Case-orientated studies concentrating on particular methodologies are presented and examples are given, addressing some of the most important aspects of structure-function relationship in biological assemblies. Biophysics nowadays collaborates closely with molecular biology and bioinformatics as well as with neurosciences, and this is also demonstrated in this book.
The book should be of interest both to experienced researchers wishing to widen their insight into molecular structure and function, and to younger scientists at the doctoral and postdoctoral level interested in the molecular nature of fundamental biological entities and phenomena.

The most insightful Bierce criticism since Davidson.......2005-03-10
This book, which demonstrates the morality and compassion of a writer who has been offhandedly dismissed as a "cynic" by many critics, made me realize why I have always been so attracted to Bierce.
Bierce's personal stoicism, coupled with his literary romanticism, resulted in some of the most memorable stories in the history of American literature.
This is the best piece of Bierce criticism since Cathy Davidson's book about Bierce's influence on the postmoderns.
Highly recommended.
