    Book Description

The law of marine insurance constitutes a major branch of the law of international trade and shipping law which is of considerable international importance. This new edition gives a clear, updated account of English marine insurance law, combining detailed analysis of modern statute and case law with a clear comprehension of practice and commerce in the shipping world. The discussion embraces not only the constantly evolving case law, but also standard forms and clauses (including the 2003 International Hull Clauses), and the rules of mutual insurance associations. Coverage includes all relevant areas of general insurance contract law as well as all issues of specifically marine insurance law. The entire text of the second edition has been considered afresh and includes significant new or additional material in particular relating to: historical background, insurable interest, policy formation, the doctrine of utmost good faith, premiums, policy interpretation, excluded losses, third party rights, losses, claims, aversion and minimisation of loss, insurers' contribution rights, and composite policies. Presenting a revised structure with the practitioner in mind, this new edition includes a new chapter on interpretation and rectification of insurance contracts.

5 out of 5 stars MARINE INSURANCE: IF YOU DARE, BRAVE THE SEA PERILS!.......2000-05-18

Chapters 1-6 comprehensively trace and communicate the golden principles of insurance, although one would have expected more contribution by the author on a problem area i.e Insurable Interest. An area beclouded thus far. Chapters 3 and 16 thoroughly present duties attaching on the assured, failling which triggers misrepresentation per commissionem and that of a per ommisionem nature. The draconian nature of warranties is effectively unbuttoned, thus the author does give a glance to an incontemtible standards and failure by the insured to 'stick to what he\she warranted'.Bennett passionately, although at pain, the resulting repudiation of the policy by the insurer in case of breach of warranty. An insurer's absolute trump card!

Chapter 4 does no wonders to contribute to the insurance intermediary question, but from the insured's angle it creates a heaven, since it tackles the scope and content of his\her mandate or instructions given to the insurance broker.

On chapters 7;8;9;10;11;12 and 13, Bennett demonstrates a depth of scholarship in his commentary on the insurable risks. Note that the most commonly used clauses in marine insurance are those of the ICC (see Appendix ii of the work under review. The work adequately journey through maritime risks and insurance in respect thereof thus ensuring security for the interested parties. Chapters 14 and 15 essentially corroborates the unanimous opinion (academic, usage, and otherwise) regarding the moment when the consignment is covered, and termination thereof. Chapter 17 comprehensively coveres what is generally known as 'cession' and authors indepth learning and observance of case law, serves as proof that this book achieved its goal i.e to contribute immensely towards a student who ventures the field, at the same time seeking to revolutinize the marine insurance law as it stands.

Lastly chapters 18;19; and 20 are taken together since they all address the question of indemnity. Althogh ch.20 differs slightly since it addresses an insurer right to 'come into the shoes' of the assured, insurance is not an investment thus if some third parties are liable towards the insured, he\she must subrogate such rights arising therefrom to the insurer.

Having this review in mind (see also the Preface of Bennett's work) the work is of a high standard. The journey undertaken by the author strengthens international trade in a sense that as the scope of marine insurance is subjected to 'litmus test', those interested in a subject but above all those engaging in sale contracts are assured of their respective obligations. The work remains a reliable witness that certainty or even uniformity can be achieved.

Schorlarly engineered; develishly presented; and downwright a international, if not eternal, mouthpiece !

Taken together, he offers an unparalleled contemporary overview of the subject by one of the most important American legal scholars of the period.

        Book Description

With the global expansion of the maritime sector, marine insurance is on the forefront nowadays, more than ever before. Notwithstanding this growth, a vast number of legal disputes continues to emerge, with indemnity being, inter alia, amidst their focal points. Accordingly, the author discusses legal issues correlated to the principle of indemnity which is entailed in such contracts as well as in disputes that may arise there under, in a representative sample of common and continental law jurisdictions. In view of the ongoing attempt for unification, undertaken by the Comité Maritime Internationale (CMI) since 1998, it has been considered essential that the discussion encompasses an international and comparative aspect. Hence, this book comparatively examines Australian, English, Canadian, French, Greek, Norwegian and U.S. law, from the angle of indemnity in marine insurance contracts, the scope for a legal reform and the potential of harmonization, in terms of achieving a better, more flexible and modern indemnification regime in marine insurance.

From the supplier: There were no major automobile insurance reform measures implemented throughout the US during 1997 but several minor changes were proposed. Some states had plans to refine their no fault insurance programs. There were also plans to implement programs that limit rights to sue while decreasing insurance premium rates.

The report by the Task Force details many developments in the market and makes recommendations for workers' comp law amendments to facilitate the acceptance of 24-hour plans. The Task Force recommended applying the benefits regime of the state in which an injured worker is regularly employed to a worker regardless of where they were injured.

From the supplier: Health insurance experts Richard Eskow and Terry Sullivan, M.D., testified to Congress that additional legislation is not necessary to allow employees to sell 24-hour workers' compensation insurance. Both men said that employers could manage to fold 24-hour coverage in with other health benefits, such as medical care, life insurance, disability, mental health care, and other potential services. Both also said that costs could be managed with coordination of the plans with physicians.

This new volume gives you a clear understanding of the requirements imposed by the Machinery Directive. Under this directive's regulations, all machinery designed for free trade must satisfy certain requirements of the European Economic Area with regard to safety. Along with the text of the Machinery Directive, you get a step-by-step explanation of the certification procedure. You are guided along the process by the book's easy-to understand text, practical examples, and well organized diagrams and drawings. CE Marking for Machinery Directive also provides an overview of the European harmonized standards, which are applicable to the Machinery Directive

                        Book Description

Notes and Tones is one of the most controversial, honest, and insightful books ever written about jazz. As a black musician himself, Arthur Taylor was able to ask his subjects hard questions about the role of black artists in a white society. Free to speak their minds, these musicians offer startling insights into their music, their lives, and the creative process itself. This expanded edition is supplemented with previously unpublished interviews with Dexter Gordon and Thelonious Monk, a new introduction by the author, and new photographs. Notes and Tones consists of twenty-nine no-holds-barred conversations which drummer Arthur Taylor held with the most influential jazz musicians of the '60s and '70s-including:

Notes and Tones is distinct in its highly synergistic dialogue. The fact that Arthur Taylor was a serious [Black] jazz drummer, with a familiar professional and personal relationship with many of the interviewees, resulted in wide ranging discussions marked by unguarded sincerity. Certain themes are touched upon numerous times [the Black Power movement & the need for jazz musicians to unite and practice cooperative economics], which while perhaps dating the book, nevertheless provide a telling contrast to the current state of affairs in the music world in general, and the social concerns of the U.S. Black community specifically. This clearly was a labor of love, and the insights shared by these iconic figures consistently inspire me to make the most of my time and efforts in whatever I'm pursuing, every time I read from the book.

                        5 out of 5 stars A 5* classic.......2004-05-05

Simply a classic! There is no other book written on jazz that even comes close. A.T.'s questions were intelligent, pointed and insightful. I loved the interview format. It gave the musicians an even wider canvas to paint on. The no-holds-barred and candid portrait of Black life should be a book to cherish for ages to come.

                        5 out of 5 stars Great book.......2001-01-04

A genuinely fascinating collection of interviews with some of the most important jazz figures of the 1950s-60s. (It's worth the purchase price just for the goofy, entertaining exchange with Dexter Gordon which opens the book.) Not only do you get an unusually intimate sense of what some of these brilliant musicians were/are actually like in "real life," but the book is particularly interesting--and frank--about the subject of race, in the jazz world and beyond. If you love jazz, don't miss this book.

5 out of 5 stars A classic for the mind, body and spirit.......2000-06-15

Arthur Taylor, a most creative source of a force in the drumming world, has created a moving, startling, and lovely group of interviews of some of the most influential artists in jazz (Black Classical) music. Giants like; Thelonious Monk, Erroll Garner, Elvin Jones, Nina Simone, Miles Davis, Dizzy Gillespie and so many others paint images of pointedness, beauty, intellect and feeling. The reader really gets an insight into the personalities and lives of these wonderful people that are the lineage of the only true American art form. I really recomend the book to anyone, from the person who has had one passing thought about jazz artists to those who dedicate their life to the art form, or any artform. This is, as they say, the real deal. I am humbled by Mr. Taylor's wonderful work and, in my own way, feel love for each of the unique artists that he interviews. Thank You Arthur!

Winograd and Flores' `Understanding Computers and Cognition' proposes that the rationalist tradition in AI must be replaced by a hermeneutic approach. Associating the rationalist tradition with the goal of building a human mind, the authors propose that a hermeneutic approach must adopt the goal of constructing prostheses which magnify the human mind. This paper argues that what AI needs is not so much a hermeneutic approach as a better appreciation of biology and psychology. Understanding Computers and Cognition is a groundbreaking book that presents an important new approach to understanding what computers do and how their functioning is related to human language, thought and action. Byte Magazine has recognized Understanding Computers and Cognition as one of the all-time 20 most influential books on information technology.

5 out of 5 stars Not Just Another Pretty Face.......2001-07-24

A few years ago Byte Magazine named this one of the 10 most important books in the history of the computer industry. Flores was asked to keynote the 50th anniversary meeting of the ACM on the strength of the work he has done, some of which is shown here.

I am a little surprised not to find a review here that shows awareness of what this book is and was intended to do -- to turn those concerned with the design of the role of computers in society into a new direction. The book offers a fundamental enrichment and extension to the traditional engineering-based foundations that are used for designing computer systems that is drawn from philosophy and biology. It opens the development of a rigorous new design milleau to the reader. This is NOT yet another multi-disciplinary rumination.

I would say this is not a "helpful" book, and it was never intended as an easy read. It is a book to turn to when one has learned enough about what is really at issue in putting computers to work in human life to discover that the likes of input, process, output, "friendly" interfaces, attractive graphical presentations, and logical flow charts are vastly insufficient distinctions for doing work that really makes a contribution to your clients and colleagues. The book challenges the reader strongly, and is not simple to read. I guess that the best way to read it is with someone else, having discussions as you go along.

This is a book to engage and grow with -- a must-read for those serious about designing and building systems that will affect the lives of those who engage with them.

                                  3 out of 5 stars A little disappointed.......2000-03-24

I read the 1986 or 87 version of this book and am of a software/AI background. I didn't follow the biological material that well - either I was being dense or it just wasn't clearly written. I thought the book was repetitious (my chief complaint). Some of the concepts discussed include: "breakdown" (humans become aware of thing X only when something goes awry in which the X is involved), "thrownness" (humans don't rationally consider all possibilities and make perfect decisions because situations they are put in don't permit such cognition and/or we simply we aren't capable of it), "blindness" (we are always somewhat blind to the prejudicies/assumptions that guide our thinking...and we can't totally escape this predicament. Also discusses the co-routine effect (per the software world) of human affects environment and environment affects world circularity.

                                  3 out of 5 stars Illuminates the concept of a user-system system.......1999-03-31

The authors' theme is that we each react to and are changed by our environment which in turn reacts to and is changed by each of us. In the end, one can design computers only within a particular consensual domain that entails at least some commonly understood rules and concepts. The authors rely heavily on the philosophical works of Maturana and Heidegger. Difficult to read as some word meanings are developed through usage and demonstration (e.g., "throwness"). Also, quotes from references are used endlessly to substantiate their theme. This is nice but I wonder after all is done, what contributions the authors' have made and how much is simply a rehash.

5 out of 5 stars Biological dependencies for cognition.......1997-11-14

This is an excellent text which describes an approach to using computers to perform an enabling role within corporate enterprises by using their ability to allow clearer understanding between participants in the workplace. The other aspect of this book looks at current methods of creating AI systems and their fundamental weaknesses. Having read this as part of my MSc. in Information Technology I have re-read it several times and I would recommend it to all those involved in complex system design, implementation and support. In addition a book such as Checklands Soft Systems Methodolgy will give a good introduction to how the systems described in Understanding Computers and Cognition can be designed to meet the demands of "real world" environments.
