Does Oral Argument Really Make a Difference?.......2005-07-07
There has always been a split of opinion as to the impact of oral arguments in the Supreme Court. Some have contended that the Justices have already made up their minds before argument, and therefore it is a wasted effort. Reports, for example, that Holmes wrote his correspondence while sitting support this contention. On the other hand, different students of the Court, including some who have made arguments, maintain that the Justices do listen, interact, and respond to critical points and it is possible to sway judgments. This is the first book I am aware of where supposition and hypothesis take a back seat to developing data on the issue. But a word of caution to the non-poliltical scientist reader: don't be scared away by the tables and statistics. The author has relegated his methodological analysis to specified sections which need only be read if you have a high pain threshold. The author's findings are interesting and suggestive: oral argument facilitates developing information not submitted in the formal pleadings; assists in identifying and forming coalitions supporting or opposing various positions; does play a role in conference and opinion writing; and can have an impact in the most critical stage, making the actual decision. Given that the author has relied upon the private papers of a very few Justices to substantiate some of his points, and further since this is a pioneering effort, there are some substantial weaknesses present in his analysis. The author sometimes overstates his case given the supporting data. However, one purpose of the book would seem to be to stimulate others to examine this topic and present their findings and justifications. The first to blaze a new trail usually ends up with an arrow or two in their hide--but that how progress is made.

Deciding to Leave: The Politics of Retirement from the United States Supreme Court was written by Artemus Ward, and published in 2003 by the State University of New York Press as part of its American Constitutionalism series.
This is not a newly-discovered work by Artemus Ward, the 19th century American humorist of Vanity Fair fame, who also wrote under the pseudonym of Charles Farrar Browne. Rather, it is by Artemus Ward, Assistant Professor of Political Science at Northern Illinois University. And Professor Ward's research, analyses and conclusions are serious indeed. He advocates for mandatory retirement to minimize what he calls "the naked partisanship of current departure-decision-making."
Not surprisingly, each of the sitting Justices declined to be interviewed for this book, a fact given some treatment in the Preface entitled "Resisting the Irresistible." That contribution notwithstanding, you should know this before drawing any conclusions about the quality of the work: The section of the book on the retirement of William O. Douglas was awarded the 1999 Hughes-Gossett Prize by the Supreme Court Historical Society and appeared in the Journal of Supreme Court History.
Regardless of position or politics, everyone in the Judiciary should read this book.

The Law's Conscience is a history of equity in Anglo-American juris-prudence from the inception of the chancellor's court in medieval England to the recent civil rights and affirmative action decisions of the United States Supreme Court. Peter Hoffer argues that equity embodies a way of looking at law, including constitutions, based on ideas of mutual fairness, public trusteeship, and equal protection. His central theme is the tension between the ideal of equity and the actual availability of equitable remedies.
Hoffer examines this tension in the trusteeship constitutionalism of John Locke and Thomas Jefferson; the incorporation of equity in the first American constitutions; the antebellum controversy over slavery; the fortunes of the Freedmen's Bureau after the Civil War; the emergence of the doctrine of "Balance of Equity" in twentieth-century public-interest law; and the desegregation and reverse discrimination cases of the past thirty-five years. Brown v. Board of Education (1954) was the most important equity suit in American history, and Hoffer begins and ends his book with a new interpretation of its lessons.

My favorite "layman's" Sierra Nevada geology book.......2001-08-03
I love this book. Of the many "layman geology" books about the Sierras that I've read, Matthes's is my favorite. I think I understand why. The book was published around 1950 by the University of California Press, shortly after Matthes's untimely death. Plate tectonics was not universally accepted at that time, so conspicuously absent from this book is the 20 pages of basic Plate Tectonics that distract the other books. Matthes instead focuses on the fascinating glacial morphology of the Yosemite region. In my mind, the book's biggest treats are the 30+ black-and-white photographic plates, including 25 by Ansel Adams. I love to see Matthes place some Adams classics in their geologic context.
In summary, this book is easy-flowing, highly informative, and visually pleasing.

This book changed my life.......2005-10-05
Words can't express how amazing this novel is. On the surface it seems like a lighthearted exploration about the trials and tribulations of life at sea - but have you really READ it? Have you? Because I haven't, but this man is the father of a friend of mine and I assume it must be amazing. He is also a prophet, which leads me to believe this book alludes to certain sections of Revelations from the New Testament that may or may not predict the apocalypse. Pick it up today at your local library for a fun read!

Rambling but with good cartoons.......2004-06-11
The book has its moments but it tends to ramble. There are sometimes to many quotes. They disrupt the flow of the text. The cartoons have to be the best part of the book. My husband got a few chuckles out of it too.

In this its finest hour, it represents the extremely hard work of several individuals who felt strongly enough about this project to devote an enormous amount of Time, Patience, and Support to it. Its purpose is twofold: to bring attention to a devastating condition, Alzheimer's, which is affecting our aging population on an ever-increasing basis, and secondly to generate a non-typical source of revenue to the local chapter responsible for increasing the public's awareness of this serious illness.
The authors and artistic contributors are receiving no monetary remuneration for their efforts. In fact, 100%...again, that's 100%...of the royalties generated by the sales of this small effort will be paid directly to the "Heartland Chapter of the Alzheimer's Association", the charity selected to benefit from this first edition of T.L.H.H.B. Hopefully, this is just the first of many such volumes that will continue to benefit this particular charity as well as several other worthy organizations in future years.
